Terms and Conditions

Last updated: 12 October 2026

These Terms and Conditions (“Terms”) apply to all services provided by Hiko-Wai Limited trading as Hiko-Wai Solutions (“Hiko-Wai Solutions”, “we”, “us”, “our”) to you (“the Client”, “you”, “your”). By requesting a quote, booking a service or accepting our work, you agree to these Terms.

1. Our Services

1.1 Hiko-Wai Solutions provides Healthy Homes assessments, property maintenance services, electrical services and heat pump installations across Auckland, Waikato and the Bay of Plenty, including Rotorua and Tauranga.

1.2 The scope of each job will be set out in our quote or written confirmation. Any work outside that scope will be treated as additional work (see clause 4).

2. Quotes and Estimates

2.1 Quotes are valid for 30 days from the date issued unless stated otherwise.

2.2 A quote is a fixed price for the work described. An estimate is our best assessment of likely cost and may change depending on what we find on site.

2.3 Quotes are based on the information available at the time. If site conditions differ from what was described or reasonably visible, we may need to revise the price, and we will discuss this with you before proceeding.

2.4 All prices are in New Zealand dollars and exclude GST unless stated otherwise.

3. Bookings, Access and Cancellations

3.1 You agree to provide safe and reasonable access to the property at the agreed time, including arranging access with tenants where required.

3.2 For tenanted properties, you are responsible for giving tenants the notice required under the Residential Tenancies Act 1986 unless we agree in writing to arrange this on your behalf.

3.3 If you need to cancel or reschedule, please give us at least 24 hours’ notice. Late cancellations or failed access may incur a call-out fee of $99.

3.4 We will do our best to arrive on time, but we are not liable for delays caused by weather, supplier delays, emergencies or other circumstances outside our reasonable control.

4. Variations and Additional Work

4.1 If you request changes, or if we discover issues that require extra work, we will tell you and seek your approval before proceeding, except where urgent work is needed to make the site safe.

4.2 Approved variations will be charged at our standard rates or as agreed in writing.

5. Payment Terms

5.1 Unless otherwise agreed, payment is due [within 7 days of invoice / on completion].

5.2 For larger jobs, including heat pump installations, we require a deposit of 50% before ordering materials or starting work.

5.3 Overdue amounts may incur interest at 12% per month and reasonable debt-collection costs.

5.4 Ownership of materials and equipment supplied remains with Hiko-Wai Solutions until full payment has been received.

6. Healthy Homes Assessments

6.1 Our assessment reports reflect the condition of the property at the time of inspection, based on what was visible and reasonably accessible.

6.2 We do not inspect areas that are unsafe or inaccessible, and we will note any such areas in the report.

6.3 Our report is intended to help you understand and work towards compliance with the Healthy Homes Standards. Responsibility for compliance and for completing any required work remains with the landlord.

6.4 Any changes made to the property after our inspection may affect its compliance status.

7. Electrical Work and Heat Pump Installations

7.1 All electrical work is carried out by licensed electrical workers in line with New Zealand electrical safety requirements.

7.2 Where required, we will provide the relevant electrical certification once the work is complete and full payment has been received.

7.3 Heat pump recommendations are based on the information available at the time of assessment, including room size, insulation and layout.

7.4 Manufacturer warranties on heat pumps and other products are provided by the manufacturer and are subject to their terms, which may require regular servicing.

8. Workmanship Guarantee

8.1 We guarantee our workmanship for 12 months from completion. If a defect arises from our workmanship during this period, we will fix it at no additional cost.

8.2 This guarantee does not cover damage caused by misuse, accidents, lack of maintenance, alterations by others or normal wear and tear.

9. Consumer Guarantees

9.1 Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where those Acts apply.

9.2 Where our services are acquired for business purposes, the parties agree that, to the extent permitted by law, the Consumer Guarantees Act 1993 does not apply, and that sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply.

10. Limitation of Liability

10.1 To the extent permitted by law, we are not liable for any indirect or consequential loss, including loss of income, rent or profit.

10.2 To the extent permitted by law, our total liability for any claim is limited to the amount paid for the services that gave rise to the claim.

10.3 We are not responsible for pre-existing faults, hidden defects or damage that could not reasonably have been identified before work began.

11. Health and Safety

11.1 We work in line with the Health and Safety at Work Act 2015. We may refuse or stop work if conditions on site are unsafe.

11.2 Please tell us about any known hazards at the property, such as asbestos, unsafe wiring, animals or structural issues, before we arrive.

12. Privacy

12.1 We collect and use your personal information only to provide our services, communicate with you and manage our business, in line with the Privacy Act 2020. See our Privacy Policy for more details.

12.2 You can request access to or correction of your personal information by contacting us.

13. Complaints and Disputes

13.1 If you are not satisfied with our work, please contact us as soon as possible so we can put it right.

13.2 We will make every effort to resolve any dispute promptly and in good faith. If it cannot be resolved, either party may refer it to mediation or to the Disputes Tribunal where appropriate.

14. Changes to These Terms

14.1 We may update these Terms from time to time. The version published on our website at the time you accept a quote will apply to that job.

15. Governing Law

15.1 These Terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
